WHAT IS THE NORTHERN VISION EXCHANGE?
The Northern Vision Exchange is a student-athlete Name Image and Likeness (NIL) business registry, custom-designed for businesses, donors, alumni, collectives and any other interested NIL partners wishing to connect with and support University of Northern Colorado student-athletes.
Registered businesses can search, filter and initiate conversations with UNC student-athletes to discuss NIL opportunities. Once an NIL deal between registrants and the student-athlete is completed, the registrant will use The Northern Exchange to create a transaction that will produce a direct payment to the student-athlete and automate a disclosure to the INFLCR Verified Compliance Ledger, as required by Colorado state law. The institution does not have to get involved in the deal, and all transactions within the exchange are consolidated into the compliance ledger for the school's review. 1099-K's are also sent to the student-athletes who meet the IRS threshold for third party payment reporting requirements.
WHAT IS NIL?
“Name, Image and Likeness” or “NIL” is a common phrase used to refer to an individual’s right of publicity – the ability to control and use one’s own unique identify for commercial promotion.
Per Colorado law, student-athletes are permitted to earn compensation from their personal NIL, or allowing a non-institutional third party to do so, without harming their intercollegiate eligibility or athletics scholarship.
A permissible NIL activity is like a job: a quid pro quo agreement in which value is exchanged between the student-athlete and a non-institutional third party. The student-athlete earns the compensation by performing a service or otherwise providing value to a third party (a business, a collective, charity, or a person). It is up to the third party to determine fair market value of the transaction.
This exchange of value may include, but is not limited to, transactional activities like endorsements and sponsorships through traditional and social media, publicity activities such as appearances, autograph sessions or monetizing a YouTube channel as well as entrepreneurial ventures like selling merchandise, conducting sports camps, or operating their own product or service-based business.
WHO CAN USE THE NORTHERN VISION EXCHANGE?
The Northern Vision Exchange is open to all businesses, groups of people, collectives, charities and individuals seeking to enter and NIL agreement or participate in NIL activities with UNC student-athletes so long as value is exchanged between both parties.
CAN UNIVERSITY OF NORTHERN COLORADO EMPLOYEES REGISTER WITH THE EXCHANGE?
Individual University employees, staff members, faculty, etc. may register with the Exchange and conduct business with student-athletes in the same manner as all other registrants, provided any resulting agreement is made in good faith of not attempting to circumvent NCAA legislation associated with the impermissible inducements and/or extra benefits.
HOW DO YOU SIGN UP FOR THE NORTHERN VISION EXCHANGE
Once you submit your information, you will receive an initial confirmation email. Once approved, you will receive another email stating you are verified in the exchange and can start proposing NIL transactions.
DO YOU HAVE TO BE AN OFFICIAL UNIVERSITY LICENSEE TO REGISTER?
No, but a business will not be permitted to use University of Northern Colorado marks without obtaining permission from the UNC Trademark and Licensing Office.
CAN A UNIVERSITY EMPLOYEE/COACH HELP ARRANGE A NIL DEAL FOR A STUDENT-ATHLETE?
No, University employees, including coaches and members of the athletics department, cannot negotiate deals or contracts. However, they can direct student-athletes to NIL-related opportunities on the Northern Vision Exchange.
WHO APPROVES AN ENTITY'S REQUEST TO REGISTER?
A member of the UNC Athletics Compliance staff is designated to approve or deny registrants. If you have any questions about your approval, contact the UNC Compliance office at 970-351-1191.
HOW WILL I KNOW IF I AM APPROVED?
You will receive an email from the Northern Vision Exchange verifying your approval.
