What is the Boilermarketplace Exchange?

The Boilermaker Marketplace Exchange is a student-athlete NIL business registry, custom-designed for businesses, donors, alumni, and any other individual interested in connecting with Purdue student-athletes for NIL opportunities. Registered businesses can search, filter and initiate conversations with Purdue University student-athletes to discuss NIL opportunities. Once the NIL deal between a registered business and a student-athlete is completed, the business will use the Boilermaker Marketplace Exchange to create a transaction that will produce a direct payment to the student-athlete (without any transaction fee) and automate a disclosure to the Purdue University INFLCR Verified Compliance Ledger. The institution does not have to get involved in the deal, and all transactions within the exchange are consolidated into the compliance ledger for the school's review. 1099-K's are also sent to the student-athletes who meet the IRS threshold for third party payment reporting requirements.

What is Name, Image & Likeness?

As of July 1, 2021, student-athletes competing in NCAA intercollegiate athletics are permitted to receive compensation for the use of their name, image or likeness (NIL) for commercial activities, including endorsements through traditional and social media, appearances, entrepreneurial activities, in-kind deals, autographs and more, in accordance with NCAA guidelines and Purdue University NIL policies and procedures.

Does Indiana have an NIL state law?

No. The NCAA issued an Interim Policy that indicates institutions located in a state with an active NIL law should follow those regulations in place of NCAA rules when governing student-athlete NIL. Institutions without a state law are allowed to create institutional NIL rules/policies. Purdue Athletics has taken a flexible and supportive approach to NIL that matches the Purdue University spirit for entrepreneurism. 

Who may register with the Boilermaker Marketplace Exchange?

The Boilermaker Marketplace Exchange is open to all businesses, entities, groups, and individuals seeking to enter an NIL agreement or participate in NIL activities with Purdue University student-athletes. 

Purdue University faculty and staff may register with the Boilermaker Marketplace Exchange to conduct business with student-athletes in the same manner as all other registrants, provided any arrangement/agreement is made in good faith of not attempting to circumvent NCAA legislation associated with impermissible offers & inducements and/or extra benefits.   

How is Purdue University or Purdue Athletics involved in NIL deals?

Neither Purdue University nor Purdue Athletics are parties to student-athlete NIL arrangements/agreements. Student-athletes engage in their NIL activities as an individual and not a representative of Purdue University or Purdue Athletics. 

A student-athlete granting a noninstitutional third party the right to use their NIL does not extend or include the ability to use the marks and logos of Purdue University, the Big Ten Conference, the NCAA or other protected marks incidental to their intercollegiate athletic participation (i.e., the Nike Swoosh on a Purdue uniform or jersey) unless the commercial entity is a licensee who secures approval through Purdue’s Trademarks & Licensing Office. Can a Purdue University coach or staff member help arrange a deal for a student-athlete?

No. Purdue coaches and staff may not negotiate deals or contracts. However, they are permitted to direct student-athletes to NIL-related opportunities via the Boilermaker Marketplace Exchange. 

Does the school or INFLCR take any revenue from NIL transactions from the Boilermaker Marketplace Exchange?

No

Who approves the request to register & how will I know when this occurs?

The Purdue University Intercollegiate Athletics Compliance Office approves registration requests. Applicants will receive an initial email upon receipt of registration. Additionally, applicants will receive an email confirming approval. After approval, businesses may begin contacting student-athletes and processing payments through the Boilermaker Marketplace Exchange. 

Do you have to be an official Purdue Athletics licensee or sponsor to register for the Boilermaker Marketplace Exchange?

All businesses are welcome to register.  

Does the Boilermaker Marketplace Exchange make me an official licensee of Purdue Athletics?

No. Businesses may not use Purdue Athletics logos or marks in NIL activities without prior written approval from Purdue’s Trademarks & Licensing Office. Please contact Sean Ward with questions regarding the application process for the NIL standard license.[email: trademarklicensing@purdue.edu].

 Does being a part of the Boilermaker Marketplace Exchange allow me to use Purdue Athletics trademarks for products in conjunction with NIL?
