WHAT IS THE SHIPYARD EXCHANGE?

 

The Shipyard Exchange is a student-athlete NIL business registry, custom-designed for businesses, donors, alumni, and any other interested NIL dollars wishing to connect with student-athletes. Registered businesses can search, filter and initiate conversations with your student-athletes to discuss an NIL deal. Once the NIL deal between a registered business and your student-athlete is completed, the business will use The Shipyard Exchange to create a transaction that will produce a direct payment to the student-athlete and automate a disclosure to the INFLCR Verified Compliance Ledger. The institution does not have to get involved in the deal and all transactions within the local exchange are consolidated into one 1099 at the end of the year for easier tax reporting purposes for registered businesses and athletes.

 

What is Name, Image & Likeness?

As of July 1, 2021, the NCAA has permitted student-athletes to be compensated for use of their name, image, or likeness (NIL). Example NIL deals could include commercial activities, product endorsements, social media posts, appearances, autographs, entrepreneurial endeavors, in-kind deals, autograph sessions, and many others. All deals with Portland State student-athletes must comply with NCAA, State of Oregon, and Portland State NIL protocols.

Does the State of Oregon have an NIL law?

Yes, the State of Oregon passed an NIL law during the 2021 regular session.

Does Portland State University have an NIL policy?

Yes, Portland State has an NIL policy that all student-athletes and outside entities must adhere to.

Can a University employee or coach help arrange an NIL deal for a student-athlete?

No. University employees or coaches CANNOT arrange, secure or negotiate NIL deals on behalf of student-athletes. Oregon State law also prohibits anyone who represented Portland State University over the preceding four years from serving as an agent for student-athletes in any NIL discussions. HOWEVER, University employees and coaches may direct interested business or student-athletes to The Shipyard Exchange where they can begin NIL activities.

Are there limits to what a student-athlete can do under the NIL rules?

Student-athletes may not participate in an NIL activity if it conflicts with class or official team activities. The activities also may not conflict with any team rules or with the terms of any contract between the University and a Third Party. Student-athletes also cannot endorse any illegal activities or the use of illegal drugs, nor can they use University trademarks or logos without written permission. Incidental use of logos (e.g. wearing team-issued warm-up, practice, or travel gear) is allowed.

I'm a business owner, what do I have to do to begin an NIL deal with a Portland State student-athlete?

Can PSU donors or alumni contract a student-athlete for an NIL deal?

Yes. They just need to follow the same rules as everyone else regarding disclosure of the deal and ensure there is a return of service from the student-athlete for the pay they received. Donors may begin the NIL process by registering on The Shipyard Exchange above.

Can PSU facilities be used in NIL deals?

Yes, though student-athletes will have to reserve the facilities themselves, and the scheduled times must be outside of class or official team activities. Their status as student-athletes won't give them preference in reserving those facilities, either.
